You can contact us at our Contact Us page. Hereinafter, any reference to 'Castlery', 'we', 'us' or 'our' shall refer to Castlery Ltd and its affiliates.

THESE TERMS OF USE APPLY WHEN YOU ACCESS AND/OR USE THE SITE. BY ACCESSING AND/OR USING THE SITE OR ANY PART OF IT, YOU AGREE THAT YOU HAVE READ THESE TERMS OF USE AND THAT YOU AGREE TO BE BOUND BY THEM. collect any data or seek to discover the identity of any Site visitor or Castlery customer for any purpose;
provide any false information in your account details;
use another person’s identity without that person’s permission or misrepresent that you are acting on behalf of a person, entity or organisation;
use the Site if we have suspended or banned you from using it.

You shall not access and/or use the Site or any Content for illegal activity or in breach of these Terms of Use.

Examples include but are not limited to:

using the Content to cause confusion to others about your relationship with us;
representing yourself as our authorised reseller or distributor when you are not;

We do not authorise any person to act as our authorised distributor or reseller. Anyone who pretends to be one is infringing upon our rights, including our trade name, logo and trademark. In such cases, we reserve the right to seek redress to the full extent of the law, including and up to criminal prosecution.

3. SALE OF PRODUCTS VIA OUR SERVICES

4.CONTENT

We own or have the rights to all the Content and all associated intellectual property rights. You have no rights in or to the Content other than to use it according with these Terms of Use. We do not allow use of the Site or its Content outside of the permitted scope defined by these Terms of Use. You should be aware that violating intellectual property laws may lead to criminal prosecution that culminates in jail time. In the event that we delete your account, we will provide you with an opportunity to export your personal information from your account.

We do not exclude or limit in any way our liability to you where it would be unlawful to do so. NOTWITHSTANDING ANYTHING TO THE CONTRARY, TO THE FULLEST EXTENT PROVIDED BY LAW, IN NO EVENT WILL THE ENTITIES OF CASTLERY LTD BE LIABLE FOR ANY INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES RELATED TO THESE TERMS OF USE OR YOUR USE, OR INABILITY TO USE, THE SERVICES, ANY WEBSITES LINKED TO IT, OR ANY CONTENT ON THE SERVICES OR SUCH OTHER WEBSITES, INCLUDING PERSONAL INJURY, PAIN AND SUFFERING, EMOTIONAL DISTRESS, LOSS OF REVENUE, LOSS OF PROFITS, LOSS OF BUSINESS OR ANTICIPATED SAVINGS, LOSS OF USE, LOSS OF GOODWILL, OR LOSS OF DATA, AND WHETHER CAUSED BY TORT (INCLUDING NEGLIGENCE), BREACH OF CONTRACT, OR OTHERWISE, EVEN IF FORESEEABLE.

THE AGGREGATE LIABILITY OF THE ENTITIES OF CASTLERY TO YOU FOR ALL CLAIMS AND DAMAGES RELATED TO THESE TERMS OF USE OR YOUR USE OR INABILITY TO USE THE SERVICES, ANY WEBSITES LINKED TO IT, ANY CONTENT OR SERVICES ON OR PROVIDED IN CONNECTION WITH THE SERVICES OR SUCH OTHER WEBSITES SHALL BE LIMITED TO THE PRICE CHARGED TO YOU IN RELATION TO THOSE SERVICES.

The limitation of liability contained in these Terms of Use will apply to the fullest extent permitted by applicable laws.

12. INDEMNITY

To the extent permitted by law, you agree to fully indemnify and hold us, our officers, directors, shareholders, predecessors, successors in interest, employees, agents, affiliates and contractors, harmless from any demands, loss, liability, claims, damage, costs or expenses (including the fees of any investigations and legal service providers), whether direct or consequential, due to or arising out of or in connection with your breach of the warranty you provide that any User Content you submit is lawful and does not infringe any third parties’ intellectual property rights.

We may also take any other action including but not limited to reporting you to the police or other law enforcement authorities, issuing a warning or taking legal action against you and pursuing any costs incurred by us as a result.

Castlery may change, discontinue or otherwise suspend any part of the Site at any time at Castlery’s sole discretion. We will try to give you reasonable notice of any suspension or withdrawal.

15. COMPLAINT PROCEDURES

In your email, please set out the following information: (a) your name and the name of your company, if any; (b) your contact information, including your email address; and (c) the nature and substance of your complaint, the specific rights at issue, and your basis for making the complaint, including the content that is objectionable.

16. CHANGES TO THESE TERMS OF USE

We may revise these Terms of Use from time to time without prior notice to you. Any revisions to these Terms of Use will be reflected on this page. If the revisions are material, we may notify you of these changes via e-mail if we have your e-mail address.

The Terms of Use in force at the time you use the Site govern your use of the Site. You must check these Terms of Use each time you use the Site. You are responsible for understanding your obligations to us under these Terms of Use. Your continued use of the Site after we post changes to these Terms of Use means you accept and agree to the changes.

17. GOVERNING LAW AND DISPUTE RESOLUTION

These terms are governed by English law. Any dispute arising out of or in connection with these Terms of Use, including any question regarding their existence, validity, or termination, shall be resolved as follows: (a) If the sum in dispute is less than £5,000: wherever you live you can bring claims against us in the English courts. If you live in Wales, Scotland or Northern Ireland, you can also bring claims against us in the courts of the country you live in. We can claim against you in the courts of the country you live in. (b) If the sum in dispute is £5,000 or more: (i) unless either you or we decide to bring proceedings in the English courts (or in your local courts if you live in other parts of the UK), it will be referred to and finally resolved by arbitration administered by the Singapore International Arbitration Centre (SIAC) in accordance with the Arbitration Rules of the Singapore International Arbitration Centre (SIAC Rules) for the time being in force, which rules are deemed to be incorporated by reference in this clause. The seat of the arbitration shall be London. The tribunal shall consist of one arbitrator. The language of the arbitration shall be English. Subject to any order by the tribunal, any hearings shall be held virtually; or (ii) you can choose to bring claims against us in the English courts. If you live in Wales, Scotland or Northern Ireland, you can also bring claims against us in the courts of the country you live in. We can claim against you in the courts of the country you live in.

Before you commence any proceedings in relation to a dispute between us and you, you shall notify us in writing, by sending an email to dpo@castlery.com. In that notice, you may require that the dispute be heard by a court of law. If you have not required that the dispute be heard by a court of law, we shall then respond to you in writing via email, within 14 days of receiving your email, notifying you of whether we elect to refer the dispute to SIAC arbitration or whether we require that the dispute be heard by a court of law. If either you or we have given notice requiring that the dispute be heard by a court of law, then the courts of England shall have non-exclusive jurisdiction to settle the dispute. If you live elsewhere in the UK, this clause does not prevent either you or us from commencing proceedings in the courts of the country you live in.

18. OTHER IMPORTANT TERMS

Each of the paragraphs of these Terms of Use operates separately and independently. If one or more of these terms is held to be invalid, illegal or unenforceable by a competent authority, it shall be deemed modified to the minimum extent necessary to make it valid, legal and enforceable and the remaining terms shall continue to be valid and enforceable. If we fail to insist that you perform any of your obligations under these Terms of Use, or if we delay enforcing our rights, that will not mean that we have waived our rights against you. You must continue to perform your obligations even under these circumstances and we will be entitled to exercise our rights and remedies at a later stage. Any waiver by us will only be done expressly in writing. Any waiver by us of your breach does not mean that we will automatically waive another breach by you.
